Website and Catalogue Information
This website provides information about Flying Baton Publications, its creators, music, audio, writing, publications, projects, services, and related activities. We make reasonable efforts to keep information accurate and current, but availability, pricing, descriptions, artwork, release dates, links, and works in development may change without notice.
Direct Webstore Purchases
Eligible publications may be purchased directly through the Flying Baton webstore. Direct-store prices are shown in Canadian dollars unless clearly stated otherwise. Payment is completed through an authorized third-party payment processor.
A completed digital purchase grants the purchaser a licence to use the purchased publication in accordance with these Terms and any licence or permission statement supplied with the individual work. Purchase does not transfer copyright or ownership of the publication itself.
Digital Delivery and Your Shelf
Direct digital purchases are available immediately after successful checkout and are associated with the email address used for the purchase. Flying Baton keeps a purchase record so that you can later recover your direct purchases through Your Shelf.
Your Shelf provides continuing access to the latest edition of a directly purchased digital publication. When a corrected or revised edition replaces an earlier file, the updated edition is the one available from Your Shelf.
Access to Your Shelf requires verification of the purchase email through a temporary secure access method. Access links are personal to the recipient and may not be sold, published, transferred, or deliberately shared to provide another person with access to purchases they do not own.
Flying Baton intends to maintain records of direct purchases on an ongoing basis. However, no online service can be guaranteed to operate forever or without interruption. Customers are encouraged to retain reasonable backup copies of legitimately purchased files. Nothing in this section limits any right or remedy that cannot lawfully be limited.
Permitted Reproduction of Flying Baton Sheet Music
Where a Flying Baton sheet-music publication expressly grants reasonable-reproduction permission, the purchaser may make a reasonable number of printed or digital working copies for the legitimate needs of the purchasing ensemble, classroom, church group, or other purchasing organization identified by the licence.
This permission is intended to allow ordinary rehearsal and performance use. It does not permit resale, commercial redistribution, posting the publication or its parts to a public website or file-sharing service, supplying copies to unrelated organizations, or otherwise distributing the publication beyond the reasonable needs of the purchaser's own authorized ensemble or organization.
Some arrangements, third-party publications, licensed works, or marketplace purchases may be governed by different reproduction terms. Where a specific publication or third-party licence conflicts with this general statement, the specific licence governs.
Copyright and Intellectual Property
Unless otherwise indicated, original text, graphics, branding, photographs, artwork, music, literary material, publication design, and other content appearing on this website are owned by, licensed to, or used with permission of Flying Baton Publications and/or the respective creators and rights holders.
The presence of material on the website or in the catalogue does not place that material in the public domain or grant permission to reproduce, distribute, perform, arrange, adapt, record, publish, resell, or otherwise use it except as permitted by applicable law or an express licence.
Where a work contains public-domain or other material not independently owned by Flying Baton, rights in Flying Baton's original arrangement, edition, publication design, branding, or other protectable contributions remain subject to the rights and limitations applicable to those individual elements.
Final Sale and Refunds
Digital products are normally final sale. Because digital publications are made available immediately and cannot meaningfully be returned once access has been granted, Flying Baton does not normally offer refunds, exchanges, or cancellations after a completed purchase.
If an incorrect title is delivered electronically, Flying Baton will provide the title you actually purchased at no additional charge. If you are charged incorrectly or more than once, encounter a delivery problem Flying Baton cannot reasonably resolve, or a refund is otherwise required by applicable law, contact us so that we can correct the problem and, where appropriate, issue a refund. If a full refund is issued for a digital publication, that purchase will be removed from Your Shelf and you will no longer have access to download or redownload that publication.
Corrections and Revised Editions
Flying Baton may correct errors, revise engraving or formatting, replace files, or otherwise update publications after release. When you purchase a digital publication directly from Flying Baton, you can return to Your Shelf at any time to download the latest edition at no additional charge.
Flying Baton may send service notifications to purchasers of a particular title when a significant correction or revision is made. These product-service messages are separate from optional promotional newsletters.
Shopping Cart and Checkout
The website uses local browser storage to remember the contents of a shopping cart. Cart contents are not a reservation, completed order, or guarantee of price or availability. A purchase is completed only after Stripe confirms successful payment and Flying Baton records the order.
If a pricing or technical error is discovered before or during fulfilment, Flying Baton may correct the error and, where appropriate, cancel and refund an affected transaction rather than knowingly fulfil an incorrect or unauthorized sale.
Newsletter and Service Email
Newsletter participation is optional and separate from making a purchase. Promotional messages are sent only where Flying Baton has an appropriate basis to send them, and promotional emails provide a way to unsubscribe.
Flying Baton may nevertheless send non-promotional transactional or service messages needed to complete or support an order, provide access to Your Shelf, respond to a customer request, or notify purchasers of a material correction to a publication they bought.
Third-Party Retailers, Marketplaces, and Services
Many Flying Baton works are also available through outside retailers, publishers, streaming services, marketplaces, or distribution partners. Purchases made through these third parties are governed by their own terms and may offer different features or benefits from purchases made directly through Flying Baton. Purchasing a product through one of our third-party distributors does not place that product on Your Shelf.
External links are provided for convenience. Flying Baton does not control third-party websites and is not responsible for their availability, content, policies, security, pricing, products, services, or transactions.
Performance, Recording, Adaptation, and Other Rights
Buying sheet music does not automatically grant every possible right connected with the underlying work. Performance, mechanical, synchronization, adaptation, arrangement, recording, dramatic, or other rights may require separate permission depending on the work and intended use.
Users are responsible for obtaining permissions not expressly included with their purchase or supplied by an authorized licensing platform.
Use of Artificial Intelligence
Flying Baton Publications uses generative artificial-intelligence tools in the creation and development of some catalogue artwork, promotional images, and other visual materials. These materials are selected, directed, edited, and incorporated into Flying Baton publications and promotional materials by Flying Baton Publications.
Acceptable Use and Security
You may not interfere with the website's operation, attempt to bypass purchase or access controls, obtain unauthorized access to administrative systems or another purchaser's Shelf, probe for vulnerabilities without authorization, introduce malicious code, or use the site in violation of applicable law.
You may not present Flying Baton content as your own or use Flying Baton branding in a manner that falsely suggests endorsement, partnership, authorization, or affiliation.
Disclaimer and Availability
Flying Baton takes reasonable care in operating the website and maintaining publication files, but does not guarantee that the website, Your Shelf, downloads, third-party services, or every item of content will always be uninterrupted, error-free, or continuously available.
Limitation of Liability
To the extent permitted by applicable law, Flying Baton Publications will not be liable for indirect or consequential losses arising solely from inability to access the website, temporary service interruptions, reliance on general website information, or use of third-party websites reached through links provided here.
Nothing in these Terms excludes, waives, or limits any consumer right, statutory protection, remedy, or liability that cannot lawfully be excluded, waived, or limited.
Changes to These Terms
These Terms may be revised as the website, webstore, catalogue, distribution arrangements, or services develop. The date at the top of this page indicates the most recent revision. Terms applying to a completed transaction will be interpreted in light of the terms and product licence applicable when that transaction occurred, except where a later change is required by law or is clearly more favourable to the purchaser.
Governing Law
These Terms are governed by the applicable laws of Canada and the laws of the Province of Nova Scotia, without regard to conflict-of-law principles, subject to any mandatory consumer-protection rules or other laws that apply to a particular purchaser.
